$300,000: Motorcycle collides with car; plaintiff suffers fractured vertebrae

CASE DESCRIPTION: On January 13, 2006 plaintiff Jerome O, 58 a correctional program supervisor with the Orange County Sheriff Department, was struck by defendant Pedro T while riding his 2003 Harley Davidson motorcycle on Alicia Parkway, near Via Lomas.  Suddenly, and without warning, defendant Pedro T, who was traveling eastbound on Alicia Parkway, turned left turn in front of plaintiff, colliding with the right side of the motorcycle.  The impact was substantial, causing plaintiff to be thrown approximately 90 feet from the point of impact.  Plaintiff’s wife, Teresa O, also brought a case against Pedro T for loss of consortium.

Mr. O  was transported from the scene of the accident to Mission Hospital, where he was hospitalized from January 13, 2006 to February 3, 2006.  As indicated by the medical records enclosed, Mr. O suffered a variety of injuries and various fractures.  As a result of his injuries, Mr. O incurred medical expenses in excess of $127,326.00.  This matter was resolved prior to filing a complaint.

RESULT: $300,000 (Policy Limits)

TYPE OF CASE: Personal Injury; Automobile v. Motorcycle; Loss of Consortium

INJURIES: C-2 fracture, T-5 through T-10 spinous process fractures, T-10 anterior body fracture, left rib fractures, left transverse process fractures at L-1, L-2 and L-3, left hemothorax, requiring left tube thoracostomy.
