$250,000: Automobile Collision in Tustin Area Causes Serious Injuries to 75-Year-Old Passenger

CASE DESCRIPTION: Joy L., a passenger in the Defendant’s vehicle, brought a personal injury claim against the Defendant, Joseph M., for his failure to slow down as he approached stopped traffic; leading to a rear-end collision.

On August 7, 2010 at around 1:50 p.m., 75-year-old Joy L. was a passenger in a vehicle being driven by Joseph M.  Mr. M. was headed southbound on Highway 55, in the city of Tustin, state of California, traveling 70 mph in the car pool lane.  At approximately 1000 feet north of 4th street, Mr. M. failed to slow down as he approached stopped traffic.  His failure to take such precaution led him to collide with the vehicle in front of him at a high rate or speed.

The collision severely injured our client, Joy L., who was a passenger in the vehicle driven by the Defendant.

Plaintiff contended that Mr. was clearly at fault for the incident and damages.  Police officers found Mr. M. in violation of California Vehicle Code Section 22350 (unsafe speed).

RESULTS: $250,000

INJURIES: The impact of the collision left Joy L. in grave condition and severely injured.   Injuries suffered by the Plaintiff include, but are not limited to the following:

1. Cephalohematoma
2. Lip Contusion
3. Non-displaced Fracture of Nasal Spine
4. Left Femoral Neck Interochanteric Fracture
5. Acute Blood Loss Anemia
