Partner Darren O. Aitken of Aitken Aitken Cohn secured a $2,500,000.00 settlement for a three-year-old boy who lost his mother in a vehicle collision caused by a military service member on active duty. Decedent was a 26-year-old homemaker who was fatally injured when defendant, operating a military Humvee at the time as part of a vehicle convoy, caused a collision on State Route 62 in the County of San Bernardino. The matter was litigated under the Federal Torts Claims Act and eventually resolved at a settlement conference in United States District Court, Central District of California.
