Plaintiff was the rear-most passenger (driver’s-side) in a vehicle traveling northbound on the highway at a low rate of speed. Plaintiff vehicle was struck from behind by vehicle owned by Defendant Company and driven inattentively by Defendant Driver. The front of the defendant vehicle struck the left rear of the plaintiff vehicle thrusting it off of the roadway, where it rolled over several times down an embankment. Plaintiff, who has no memory of the collision, was ejected from the van.
$2,500,000 settlement
The investigating officer concluded that the defendant truck driver caused the collision by driving at a speed greater than is reasonable or prudent. Plaintiff was a negligent free passenger.
Defendants contended that the vehicle in which plaintiff was riding was traveling at a slow and unsafe speed.
