Partners Rich Cohn and Casey Johnson secured an $11,000,000 settlement on behalf of a 20-year-old client who was rendered a quadriplegic after diving into an unsafe HOA swimming pool.
Isaac L., the client, was visiting his father at his condominium for a family pool BBQ. After visiting with family in the pool area for about 15 minutes, Isaac dove into what he believed was the deep end of the pool. However, the pool was uniquely designed to have a deep side as opposed to a deep end, so Isaac instead dove into the sloped embankment of the shallow side of the pool. The pool also failed to provide required and recommended warnings including the lack of a visible “No Diving” sign, the lack of “No Diving” tiles in the deck of the pool, and the lack of legible in-pool depth markers.
