$195,000: Motorcyclist Involved in Broadside Collision after Motorist Performs Unsafe Left Turn

CASE DESCRIPTION: On August of 2013, Plaintiff was riding his motorcycle westbound in the number two lane of Culver Boulevard. As he proceeded, defendant, without warning, turned directly in front of him from eastbound Culver Boulevard attempting to turn onto Berryman Avenue, violating Plaintiff’s right of way. Plaintiff had no opportunity to avoid defendant’s vehicle, and a broadside collision ensued. Plaintiff sustained orthopedic injuries, including right knee fracture; right shoulder pain; left knee multiligamentous injury; and left hand fractures.
FINAL RESULT: $195,000 settlement
Plaintiff contends that the cause of the accident was the sole cause of defendant who was driving her vehicle in violation of California Vehicle Code Section 21801 “Unsafe Left Turn.” Defendant was driving under a learner’s permit under her mother’s supervision at the time of the collision. Defendant ultimately conceded liability prior to Defendant’s deposition.

PLAINTIFF’S INJURIES: Plaintiff sustained orthopedic injuries, including right knee fracture; right shoulder pain; left knee multiligamentous injury; and left hand fractures. Plaintiff underwent open reduction internal fixation of the second metacarpal. The knee injuries were treated non-operatively.
