CASE DESCRIPTION:                              

On July 10, 2019 Patrick C. (age 59, at the time) was riding his bicycle on Hidden Hills Road near Stonewood Drive in the City of Yorba Linda, California.  Around 10:00 a.m., defendant, Taylor H. was traveling eastbound on Hidden Hills Road preparing to turn northbound onto Stonewood Circle in her 2003 Toyota Camry.  As defendant Mr. H. turned to go northbound on Stonewood Circle, she collided with   plaintiff, Patrick C., who was lawfully within the intersection of westbound Hidden Hills Road along the north curb line.

PLAINTIFF’S EXPERTS: None disclosed

 PLAINTIFF’S INJURIES: Broken toe/dislocated toe on left foot; Broken foot (metatarsal); broken ankle; broken left leg; 5 fractured ribs; fractures at C7 and T3.

PLAINTIFF’S CONTENTIONS   

AS TO LIABILITY:                       

Officer B. Swain of the Orange County Sheriff’s Department obtained a statement from the Defendant driver, Ms. H., who admitted that she did not see Patrick while making a left turn onto Stonewood Circle from Hidden Hills Road.  Officer B. Swain noted property damage of the impact consisted of minor damage to Ms. H.’s vehicle, and Patrick C.’s bicycle suffered major damage.

Officer Swain determined that Ms. H. was the cause of the accident in that she entered an intersection attempting to make an unsafe left turn in violation of CVC21801(a).

DEFENDANT’S CONTENTIONS

AS TO LIABILITY: The matter settled pre-litigation.  Defendant never asserted any liability contentions.
